Affiliate Terms of Service – Code of Conduct
1. Independence of Affiliates
Affiliates of BamBoost (hereinafter referred to as "we" or "our shop") operate as independent entities and are not employees, agents, or legal representatives of BamBoost. Affiliates are solely responsible for their own promotional activities and any claims or representations made in connection with their marketing efforts.
As independent business operators, affiliates must comply with all applicable laws, regulations, and ethical guidelines related to advertising and promotional activities. BamBoost assumes no liability for the actions, omissions, or content created by affiliates.
2. Rules and Responsibilities for Affiliates
To ensure a fair, accurate, and legally compliant representation of our products, all affiliates must adhere to the following rules:
2.1. Truthful and Scientifically Backed Content
- All claims and statements made about BamBoost products must be truthful and based on verified, scientifically backed information.
- Affiliates must not make false, misleading, or exaggerated claims regarding the benefits, effects, or characteristics of the products.
- Sources of scientific claims must be cited and conform to current standards of evidence-based research.
2.2. Compliance with Legal Advertising Standards
- Affiliates must comply with all applicable advertising laws, including but not limited to the Gesetz gegen den unlauteren Wettbewerb (UWG) and regulations outlined by the German Heilmittelwerbegesetz (HWG), which govern marketing practices for health-related products.
- Marketing of supplements must not imply that the products can prevent, treat, or cure diseases unless explicitly permitted by applicable laws and supported by scientific evidence.
- Affiliates are prohibited from using unsubstantiated health claims or testimonials that could mislead consumers.
2.3. Ethical Marketing Practices
- Affiliates must ensure that their marketing content (including text, images, and videos) is ethical, respectful, and professional.
- Spam, unauthorized email marketing, or deceptive practices (such as fake reviews or hidden advertisements) are strictly prohibited.
- Affiliates must clearly disclose their affiliation with BamBoost in accordance with relevant transparency and disclosure laws, such as §5a of the UWG.
2.4. Protection of BamBoost's Reputation
- Affiliates must refrain from engaging in activities that could harm BamBoost’s reputation, such as promoting products in inappropriate contexts or associating with controversial content.
- Affiliates are not permitted to engage in illegal or unethical practices while promoting BamBoost products.
3. Termination of Affiliate Status
BamBoost reserves the right to terminate an affiliate's status immediately and without notice if the affiliate violates any of the above rules or engages in any activity deemed detrimental to the company or its customers.
4. Liability Disclaimer
BamBoost disclaims all liability arising from the actions, omissions, or content produced by affiliates. Any disputes, claims, or regulatory issues stemming from an affiliate’s promotional activities are the sole responsibility of the affiliate.
5. Agreement to Terms
By participating in the BamBoost affiliate program, affiliates agree to comply with this Code of Conduct and acknowledge that they are acting as independent entities. Failure to adhere to these terms may result in termination of affiliate status and legal consequences where applicable.
